1. Use of the App

1.1 Eligibility

By using our App, you represent and warrant that you are at least 13 years of age. If you are under 18, you must have obtained parental or guardian consent. Users under 13 are not permitted to use this App. If you are accessing or using our App on behalf of a company or organization, you represent and warrant that you have the authority to bind such entity to these Terms.

1.2 Account Registration

The App offers anonymous, Google, and Apple Sign-In options. Anonymous accounts may lose data on reinstall. Google and Apple Sign-In enable cross-device sync and account recovery. You are responsible for maintaining the security of your device and account credentials. Accounts cannot be linked between providers — once you sign in with a specific provider, you must continue using that same provider.

1.3 Acceptable Use

You agree to use our App in compliance with applicable laws and regulations and these Terms. You shall not:

• Use our App for any unlawful or unauthorized purpose
• Attempt to gain unauthorized access to our App or any associated systems
• Interfere with or disrupt the operation of our App or AI analysis services
• Engage in any activity that could harm or impair our App's functionality
• Abuse our AI analysis features through automated scripts or excessive usage
• Store content that violates applicable laws or community standards
• Attempt to reverse engineer or extract our AI analysis algorithms
• Share or distribute dream content belonging to others without permission

2. Dream Content and Data

2.1 Your Dream Data

You retain ownership of all dream content you create, record, or input into the App. Your dream data is stored locally on your device by default. When you use our AI analysis features, your dream content is temporarily processed by our secure cloud functions but is not permanently stored on our servers.

2.2 Voice Recordings

The App includes voice recording functionality for dream capture. Voice recordings are converted to text using your device's speech recognition capabilities and may involve third-party speech processing services. On supported devices, original audio recordings are saved locally on your device for playback. Voice recordings are stored on-device only and are not included in cloud backups. Recordings are automatically deleted when the associated dream is deleted.

2.3 AI Analysis Content

When you request AI analysis of your dreams, the App processes your dream content to provide insights, pattern recognition, and symbolic interpretation. The analysis results generated by our AI become part of your personal dream journal data.

3. Intellectual Property

3.1 App Ownership

Our App, including all content, features, functionality, AI algorithms, and user interface, are owned by us or our licensors and are protected by intellectual property laws. You acknowledge and agree that all rights, title, and interest in and to our App, including any intellectual property rights, are and will remain the exclusive property of Zen Zero Pty Ltd.

3.2 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our App for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any part of our App without our prior written consent.

4. Premium Features and AI Analysis

4.1 Free Tier

The App provides free users with the following capabilities:

• 3 total AI analyses (one-time credits, subject to change)
• Dream recording and local storage
• Cloud backup and cross-device sync
• Standard search and filtering features
• Cooldown between analysis requests

4.2 Premium Subscription

Premium subscription provides unlimited AI analysis with fair usage limits, advanced analytics, and priority support. Subscription payments are processed through RevenueCat and your device's app store (Google Play or Apple App Store).

4.3 Fair Usage Policy

To ensure quality service for all users, we implement fair usage limits including:

• Cooldown periods between AI analysis requests
• Rate limits on analysis frequency
• Daily and hourly usage caps for premium users
• Restrictions on automated or excessive usage

Specific limits may be adjusted to maintain service quality and are enforced automatically by the app. Excessive usage that violates these limits may result in temporary restrictions or account suspension.

4.4 Payment and Refunds

All financial transactions are processed by third-party payment processors. We do not store your payment information. Refund policies are governed by the respective app store policies (Google Play or Apple App Store).

5. AI Services and Third-Party Integration

5.1 AI Analysis Disclaimer

Our AI analysis features are provided for entertainment and self-reflection purposes only. AI-generated dream interpretations should not be considered as professional psychological, medical, or therapeutic advice. We make no warranties about the accuracy, completeness, or reliability of AI analysis results.

5.1.1 AI-Generated Images Disclaimer

Our AI image generation feature (available for analyzed dreams) uses artificial intelligence to create visual representations of your dreams. By using this feature, you acknowledge and agree that:

• No Accuracy Guarantee: Generated images are artistic interpretations and may not accurately represent your dream
• Content Safety: Despite safety filters, AI may occasionally generate inappropriate, unexpected, disturbing, or offensive imagery. We implement multi-layer content filtering, but cannot guarantee 100% safe output
• No Liability: We are not responsible for the content, quality, accuracy, or appropriateness of AI-generated images
• Entertainment Purpose: Generated images are for personal entertainment and creative inspiration only
• One Image Per Dream: You may generate only one image per analyzed dream (no regeneration allowed)
• Third-Party Processing: Images are generated using third-party AI services, subject to their terms and policies
• Storage: Generated images are stored in cloud storage and tied to your account
• User Responsibility: You are responsible for how you use, share, or distribute generated images
• No Copyright: AI-generated images may have complex copyright implications. We make no warranties regarding intellectual property rights

If you encounter inappropriate or disturbing AI-generated images, please delete the dream and contact us at dreamlusive@zenzero.app with details. We continuously improve our safety measures but cannot eliminate all risks associated with AI-generated content.

5.2 Third-Party Services

Our App integrates with third-party services including:

• AI service providers for dream analysis and image generation
• Cloud services for authentication, data processing, and storage
• Payment processors for subscription management
• Device speech recognition services

We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of third-party services is subject to their respective terms and policies.

6. Disclaimers and Limitations of Liability

6.1 Service Availability

We strive to provide reliable and uninterrupted App functionality. However, we do not guarantee that our App will always be available, error-free, or free from interruptions. AI analysis services may be subject to limitations, delays, and temporary unavailability beyond our control.

6.2 Data Loss

While we implement security measures to protect your data, we cannot guarantee against data loss due to device failure, software bugs, or other technical issues.

6.3 Disclaimer of Warranties

Our App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We disclaim all warranties, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.4 Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use or inability to use our App, including but not limited to loss of dream data, AI analysis errors, inappropriate or offensive AI-generated images, reliance on AI-generated content, emotional distress from AI-generated imagery, or any other damages related to AI image generation features, even if we have been advised of the possibility of such damages.

7. Content Responsibility

You are solely responsible for the content you input into the App, including dream descriptions, voice recordings, and any other data. You agree not to input content that is illegal, harmful, threatening, abusive, or violates the rights of others. If you submit feedback or suggestions about our App, we may use your feedback without obligation to you.

8. App Updates and Changes

The App may update automatically on your device once a new version or feature is available. Some devices may let you adjust your automatic update settings. We reserve the right to modify, update, or discontinue any features of the App, including AI analysis capabilities, with or without notice. You may not copy, modify, distribute, sell, or lease any part of our App or included software, nor may you reverse engineer or attempt to extract the source code.

9. Indemnification

You agree to indemnify, defend, and hold harmless Zen Zero Pty Ltd and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of our App, violation of these Terms, misuse of AI analysis features, or infringement of any intellectual property or other rights.

10. Termination and Account Deletion

We reserve the right to terminate or suspend your access to our App at any time and for any reason without prior notice or liability, including but not limited to violation of fair usage policies or these Terms. If you do not agree to any modifications to these Terms, you should discontinue your use of our App. Upon termination, your local data will remain on your device unless you choose to delete it.

You may delete your account at any time from within the App by going to Backup & Restore and tapping "Delete Account." Account deletion is immediate and permanent — your Firebase account, cloud backups, and associated server-side data will be removed. Local dream data remains on your device. Any active subscriptions should be cancelled separately through Google Play or Apple App Store.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where Zen Zero Pty Ltd is incorporated, without regard to its conflict of law provisions.

12. Miscellaneous

These Terms constitute the entire agreement between you and Zen Zero Pty Ltd regarding the use of our App. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. If we don't take action right away when you violate these terms, this doesn't mean we're giving up any rights we may have.
